These terms and conditions outline the rules and regulations for using IndianShelf and the products and services offered by the vendors listed on this website.

Acceptance of Terms

By accessing the IndianShelf website and mobile applications ("Platform"), you agree to be bound by these website terms and conditions, whether you are a visitor, buyer, or vendor.

Access and Listings

IndianShelf grants vendors non-exclusive, non-transferable access to list and sell products on the platform. IndianShelf reserves the right to review, moderate, suspend, or terminate any vendor account if policies or terms are violated. IndianShelf reserves the right to suspend or terminate the access and account of Vendors found in violation of any terms, guidelines, or policies, including but not limited to infringement issues, listings of prohibited items, shipping delays, etc., at its sole discretion.

Vendors must provide accurate and complete information for each listing, including product specifications, price, shipping costs and timelines, return policy, etc. Listings should not infringe on any third-party intellectual property rights.

Product Image and Listing Guidelines

The vendor shall comply with the prescribed standards and guidelines established by IndianShelf for product images and listing information.

The minimum specifications are a 2000px x 2000px image resolution and a maximum file size of 5MB per image. The vendor represents and warrants that the photos and listings do not infringe on third-party intellectual property rights. IndianShelf reserves the right to review, moderate and delete any vendor product listing which IndianShelf does not find suitable for IndianShelf website. IndianShelf encourage vendors to list hand made products preferably made in India or any product which is unique in nature but does not infringe on any third-party IP rights or prohibited by Government of India. It is mandatory for all vendors to keep inventory upto date, products will get delisted from IndianShelf platforms in case the inventory is not updated once in 45 days. IndianShelf reserves the right to delist vendors listings in case order gets cancelled because of unavailability of the product with vendor.

Sale Proceeds and Commission

IndianShelf will receive a commission of 30% of each product's sale price, including applicable taxes. Vendors will receive the remaining sale proceeds after deducting cancellations, refunds, discounts, fees, etc.

Payment Cycles

Payment of sale proceeds to vendors will be made within 45 days from the order date, irrespective of other dates. Any delays due to unforeseen circumstances shall be promptly notified to the Vendor. IndianShelf has the right to hold payment of any order which is disputed by IndianShelf, vendor or customer till resolution.

Shipping and Returns

Vendors are responsible for shipping products to buyers per the timelines and policies listed. IndianShelf is not involved in product packaging, shipping, or delivery. For products received back from customers for any valid claim or return request under return policies, vendors shall coordinate with buyers to facilitate refunds or replacements as soon as possible without any additional liability to IndianShelf. Moreover, vendors selecting the shipping timeline and return policies mentioned on their listing should abide by the conditions within the period.

Intellectual Property

The IndianShelf name, brand, trademarks, technology, content, and infrastructure are the intellectual property of India Art Place. Product images and listings should not infringe on any third-party IP rights.

Data Privacy

IndianShelf will not share any user data or personal information with third parties without explicit consent from the user. User data is considered confidential and will be protected as per privacy laws.

Advertising

IndianShelf may display product images, descriptions, and other listing content on third-party platforms for advertising and marketing. However, user data or personal information will not be shared without consent.

Dispute Resolution

The vendor is responsible for resolving any claims or disputes between the buyer and the vendor. In cases where IndianShelf steps in, IndianShelf shall have the sole discretion to settle such disputes, and its decision in determining matters shall be final.

Jurisdiction

The laws of India shall govern and construe these terms and conditions. Any disputes arising with IndianShelf shall be subject to the exclusive jurisdiction of the competent courts in New Delhi.
